Nautilus is a DBA of High Pulse Media, Inc. (“Nautilus”, “We”, “Us” or “Our”), we respect your privacy and take protecting it seriously. It also describes the choices available to you regarding our use of your personal information and how you can access and update this information. Definitions

“Customer” is any person or entity that maintains an account with Nautilus using the Services we provide. Nautilus is a controller of our Customer’s information.

“Subscriber” is any person or entity that our Customers contact through the use of Nautilus Services. Subscriber information is controlled by Customers and provided to Nautilus for processing at their direction. A Subscriber is a Customer of a Nautilus Customer.

“Affiliate” is any person or entity participating in the Nautilus Referral Program for the purposes of referring potential Customers to Nautilus. An affiliate controls potential Customer information until processed by Nautilus to create a new Customer account.

“Visitor” is any person that visits our website.

“You” and “Your” could refer to a Customer, Subscriber, or Affiliate based on context within this policy.

Information We Collect

Nautilus does not sell Customer, Subscriber, Affiliate, or Visitor information we collect to anyone.

Our Data Processing and Security Terms contain more information about how we process data, the security we provide you, your data rights, and information on sub-processors we use to fulfill Nautilus Services.

"I am A Nautilus Customer and/or Affiliate"

Information You Provide To Us: When engaging with Nautilus, you provide us with information so we can provide the email marketing services and/or affiliate services described on our website. Compulsory and voluntary information collection will be distinguished at the time it is collected. Information may include, but is not limited to, the following:

Account Information: We collect contact information like your name, email address, mailing address, phone number/fax number to identify your account, provide you support, and communicate with you.

Additional Customer Information:

  • Billing Information: We collect credit card information in order to process your payments for Nautilus Services.
  • Subscriber Information: You provide us with Subscriber information to process using our Services.

     

  • Integration Information: You provide us with information to connect integrations which may provide further information to Nautilus based on your instructions.

Additional Affiliate Information:

  • Payment Information: We collect tax ID numbers, SSNs, and other information to process your referral payments for Nautilus Services and meet United States federal tax requirements.

Information We Collect Automatically: While visiting our site and while using Nautilus Services, Nautilus collects information about your device and usage. Information may include, but is not limited to, the following:

  • Device Identifiers: We collect online and device identifiers like IP address, geographic information, and browser and operating systems. This includes mobile devices using our Mobile Applications.

  • Service Usage: We collect information about how you use our Services which includes dates/times of access and browsing activities performed on our site. Nautilus also uses cookies, HTML5, and log files. See the Security section of this policy for more information.

     

Information We Collect From Other Sources: Nautilus may gather information about you from publicly available sources including, but not limited to, your website domains and URLs, company information, publicly available social media accounts and other publicly available websites.

Use of Information

Nautilus will use your information for legitimate and lawful purposes including, but not limited to the following.

  • Sending Newsletters and Marketing: Nautilus will subscribe you to our newsletter(s), we will use your name and email address to send the newsletter to you. Nautilus will promote our new products, services, and other materials to you when they are launched. If you no longer wish to receive our newsletters or marketing, you may follow the unsubscribe instructions contained in each of the communications you receive.
  • Sending Service Related Emails: We may send you service related email announcements on rare occasions when it is necessary to do so. For instance, if our service is temporarily suspended for maintenance, we might send you an email. You do not have an option to opt out of these emails, which are not promotional in nature.

     

  • Providing Support to You: Your information is used whenever you contact Nautilus for Support. Nautilus will use your information in any incident response or system defect analysis which may include proactive emails or phone calls to you concerning your account. These support communications may be mandatory as they are not promotional in nature. You will be asked to verify pieces of information when interacting with Customer Support.

     

  • Personalizing Your Experience: Based on your information, Nautilus may personalize aspects of our Service to provide you a better user experience. This may include automatically creating content using your information. You can always choose to use the content we create or delete it.

     

  • Making Suggestions to You: Based on your information, Nautilus may suggest ways to use our Services or recommend third-party integrations, services, or content that could benefit you.

     

  • Improving Our Services: Your information may be used to provide insights that allow us to continually improve the Services we provide. Nautilus may use your data individually or combine it with other data to establish trends. We may present you opportunities through surveys, or we may contact you directly, to opt-in to additional 1-on-1 communications to provide us feedback on our services, participate in a Beta release group, or participate in other forms of interviews.

     

  • Detecting Fraud and Misuse of our Services: We use your information in a variety of automated and manual analysis to ensure we process only legitimate and lawful emails from our Customers. Nautilus may use your data individually or combine it with other Customer’s to establish trends. This benefits all Customers as it reduces spam and allows our deliverability to remain high.

     

  • Testimonials: We post Customer and Affiliate testimonials on our website, which may contain personal information. We do obtain your consent to post names along with testimonials via email prior to posting the testimonial on our website. However, if you wish to request the removal of your testimonial, please contact us.

     

  • Meeting Legal Requirements: We reserve the right to disclose your personal information as required by law, such as to comply with a subpoena, bankruptcy proceedings or similar legal process, and when we believe that disclosure is necessary to protect our rights, protect your safety or the safety of others, investigate fraud and/or to comply with a judicial proceeding, court order, or legal process served on our website.

     

  • Business Transition: In the event we go through a business transition, such as a merger, acquisition by another company, or sale of all or a portion of its assets, your personal information will likely be among the assets transferred. Additional Customer Uses:

  • Enabling Integrations: Nautilus uses your data to allow integrations to interact with your data. Nautilus does not and cannot control any integration partner’s actions. Your decision to use any integration is at your discretion.
    • For Example, Facebook Connect: You can connect your account to social media websites using services like Facebook Connect. These services will authenticate your identity and provide you the option to share certain personal information with us, such as your name and email address, so you can share messages on these websites. Services like Facebook Connect give you the option to post information about your activities on this website to your profile page, allowing you to share with others within your network.

       

  • Collecting Money Owed to Us: Nautilus will use your information to send you invoices, charge your credit card on file, and send you other Service related billing notifications.

Paying Money Owed to You: Nautilus will use your information to send you payments, tax information, and other communications as required by United States federal tax requirements.

"I Am A Subscriber To An Email List Processed By Nautilus"

We collect your information under the direction of our Customers, and have no direct relationship with you, whose personal data we process. We work with our Customers to help them provide notice to their subscribers concerning the purpose for which personal information is collected.

We do not contact you directly. We do not sell or share your information with any other Customer, Subscriber, or Visitor unless explicit consent is granted by you.

Information You Provide To Us: When you fill out a Nautilus provided sign-up form, you provide us information directly like your name, email address, and other contact information our Customer asks to collect on their behalf. This information may be required or optional solely at the Customer’s discretion.

Information We Receive From Customers: Customers provide us with information they collect from you via other channels like integration partners, in-person sign-ups, or other means of consent between you and the Customer.

Information We Collect Automatically: When you interact with our emails, we collect information about your Service usage like the date and time you opened the email, any links you clicked and when you clicked them.

Use of Information

Detecting Fraud and Misuse of our Services: In order for Nautilus to prevent Spam and protect Inboxes, we review Customers’ mailing lists, which contain your data, with a variety of automatic tests. Our staff also manually reviews mailing lists, and your data, for any signs of irresponsible emailing by our Customers.

Providing Services to Our Customers: We will retain personal data we process on behalf of our Customers for as long as needed in order to provide services to our Customers.

Meeting Legal Requirements: We will retain and use this personal information as necessary to comply with our legal obligations, resolve disputes, and enforce our agreements.

Business Transition: In the event we go through a business transition, such as a merger, acquisition by another company, or sale of all or a portion of its assets, your personal information will likely be among the assets transferred. You will be notified via email of any such change in ownership or control of your personal information.

Data Inquiries

If you are a subscriber of one of our Customers and would no longer like to be contacted by our Customer, please contact the Customer that you interact with directly.

We have no direct relationship with the Subscribers whose personal data we process. We acknowledge that you have the right to access your personal information. An individual who seeks access, or who seeks to correct, amend, or delete inaccurate data, should direct his or her query to our Customer (the data controller). If our Customer requests that we remove the data, we will respond to their request within 30 business days.

Information We Share

We will share your personal information with third parties only in the ways that are described in this privacy policy and our Data Processing and Security Terms to provide the email marketing services described on our website.

We use other third parties to provide our Services. When you sign up for our Services, we will share your personal information only as necessary for the third party to provide that Service. This could include billing information provided to a credit card processing company to bill you for services or location, geographic information, device IDs, and online identifiers for personalization, or contact information to provide Live Chat and other Customer Support services while using our website.

Transfers to subsequent third parties are covered by the provisions in our Policies regarding notice, choice, and the service agreements with our Customers.

Choices Concerning Your Data and Our Service Providers

Nautilus does not disclose or distribute collected personal information to non-agent third parties. Nautilus will offer individuals the opportunity to choose (opt-out) whether their personal information is to be disclosed to a non-agent third party.

Nautilus will provide the opportunity to choose (opt-in) when their personal information to be used for a purpose other than the purpose for which it was originally collected. Nautilus will provide individuals with reasonable mechanisms to exercise their choices by contacting us or following instructions as presented in this policy.

Access To Personal Information

Upon request we will provide you with information about whether we hold any of your personal information. If your personal information changes, or if you no longer desire our services, you may correct, update, delete or deactivate it by making the change on our member information page or by contacting us. We will respond to your request within 30 days.

We will retain your information for as long as your account is active or as needed to provide you our Services. We will retain and use your information as necessary to comply with our legal obligations, resolve disputes, and enforce our agreements. The security of your personal information and our Customer’s information is important to us. When you enter sensitive information, such as login credentials and credit card information, we encrypt the transmission of that information using secure socket layer technology (SSL).

We follow generally accepted standards to protect the personal information submitted to us, both during transmission and once we receive it. No method of transmission over the Internet, or method of electronic storage, is 100% secure, however. Therefore, we cannot guarantee its absolute security.
